Validity of Terms and Conditions

These Terms and Conditions are a binding Contract between private Clients or Companies who choose to use the Forester Beauty Supplies (Fox Arts Comics) Website. By placing an Order the Client agrees that he understands and accepts the Terms and Conditions as portrayed on the Forester Beauty Supplies (Fox Arts Comics) Website without reservation. These Terms and Conditions regulate the proceedings between Forester Beauty Supplies (Fox Arts Comics) and its Clients. Both parties declare to adhere to the Terms and Conditions unconditionally. These Terms and Conditions also apply for Orders placed by Telephone, Fax or E-Mail. The Client will be advised to check the valid Terms and Conditions on the Website.

Ordering

An Order is deemed binding as soon as the Client activates the “Place Order” button which is to be found on the “Order Review” page. By completing an Order the Client acknowledges the purchase of the chosen Products.

Forester Beauty Supplies (Fox Arts Comics) maintains the right to accept or refuse any placed Order. Forester Beauty Supplies (Fox Arts Comics) confirms the acceptance and further processing of an Order via the Clients e-mail address, which is provided at the time of online registration. That e-mail is a binding Contract between Forester Beauty Supplies (Fox Arts Comics) and its Client.

Forester Beauty Supplies (Fox Arts Comics) will not be held accountable for any delays or undelivered goods due to errors in the mailing address. In case of delivery problems due to delays from the manufacturer or distributor, Forester Beauty Supplies (Fox Arts Comics) will seek an alternate solution with the Clients consent.  For unredeemed parcel returned to Forester Beauty Supplies (Fox Arts Comics), the Client will receive an invoice for the cost of the delivery, return delivery and administration. By placing an Order with Forester Beauty Supplies (Fox Arts Comics), you attest to being over the age of 18, or the age of legal maturity and in full mental sagacity.

Products

The Product photos on this Website are not a binding part of the Contract between Forester Beauty Supplies (Fox Arts Comics) and its Clients. Forester Beauty Supplies (Fox Arts Comics) is not liable for mistakes on the homepage. Technical details and/or the content of the delivered Products can differ from the details of the Product manufacturer or the description on the internet. Due to various possible monitor settings, pictures of our Products might not be shown in the right color and could be different from the original Product. All details on foresterbeauty.com are without guarantee and Forester Beauty Supplies (Fox Arts Comics) cannot be held responsible.

Prices

Our prices are stated in Swiss francs (Fr.) and include the sales tax (vat) of 8%. The prices do not include the cost for shipment, which will be added at check out. Whilst we try to ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur, regardless of potential errors between the time of purchase and time of delivery, the prices at the time of purchase are binding. Forester Beauty Supplies (Fox Arts Comics) reserves the right to modify the information on this Website or the prices for various services or Products. The content of this Website and all prices are subject to change without notice.

Payment Methods

-TWINT and PayPal

We accept TWINT and PayPal. The total cost of your Order will be deducted from your credit card or PayPal account before your Order is dispatched. Forester Beauty Supplies (Fox Arts Comics) uses security enabled procedures to transfer funds and information. Should you not own a credit card or choose not to use your credit card online, we offer this alternative method of payment.

-Advance Payment

You pay for your purchase, “shipping cost included” in advance via our Bank Account: IBAN CH80 0070 0110 0045 1937 1 (Beneficiary: Beat Walder, Fox Arts Comics). Please fill in your purchase Order number on the payment slip. The delivery of your purchase will follow as soon as we receive your Payment.

Delivery

All local orders are delivered via Post Pac Priority. The shipping costs are charged according to weight, and are as follows:

Parcels up to 2kg                                   Fr. 9.00

Parcels from 10kg up to 20kg                 Fr. 15.00

Each Order is properly inspected and packed before shipping. When possible Orders are packaged as one parcel, should an Order have to be shipped in multiple packages due to volume. The Client will be notified to expect different delivery times for each package due to possible postal delays or matters which we cannot influence, in which case Forester Beauty Supplies (Fox Arts Comics) will not be held accountable.

Should you not be home at the time of delivery, the postman will leave a notification slip stating that you should pick up your package within 7 days at the specified post office on your own account. Forester Beauty Supplies (Fox Arts Comics) will not be held responsible for improper handling of a delivery after it has left our company. Shipments are generally made the day after your Order has been placed with Forester Beauty Supplies (Fox Arts Comics), weekends exempted. Provided that all the Products ordered are on stock. Shipped goods should be received within two working days. The Client is able to check the shipping or delivery status of his Order on the Forester Beauty Supplies (Fox Arts Comics) Website. Shipment is momentarily only available in Switzerland and Lichtenstein. Incorrect deliveries are to be reported to info@foxartscomics.ch immediately. Wrongly delivered or not ordered goods must be returned to Forester Beauty Supplies (Fox Arts Comics) unless the Client chooses to buy that said item. All unreturned items will be charged in full at the current price.

Returns

Before returning any unwanted goods to Forester Beauty Supplies (Fox Arts Comics) the Client must contact the customer service department via info@foxartscomics.ch . Within 7 days after receiving the Products.

Shipments returned without prior permission will be refused. Our permission for the return of a shipment will be given via e-mail within 48 hours. Returned goods must be in their original packaging. Used or opened Products are excluded from our return policy as are worn T-shirts. Should we determine that the goods in a returned shipment are used and therefore not resalable to another Client Forester Beauty Supplies (Fox Arts Comics) reserves the right to refuse reimbursement in which case you will be charged in full at the original price plus cost for re-shipment. 

Liability for Online Connections

The provider vows to make all reasonable efforts to ensure that the programs and systems used by this Website are free from viruses and maintained according to current technical standards, as well as abide to data privacy protection laws. The Client is responsible for the security of any systems, programs or data in regards to his or her account. Passwords or usernames should never be passed on to third parties. Forester Beauty Supplies (Fox Arts Comics) will not be held liable for any loss or damage to your computer files programs or information arising as a result of your use of this Website. In addition Forester Beauty Supplies (Fox Arts Comics) is not liable for any loss due to force majeure, incorrect usage and negligence of security warnings by customers or third parties, excessive usage, unsuitable information technology of the Client by third parties, extreme environmental conditions, interference by the Client or threats by third parties (Worms, Viruses, Trojans etc.), which occur despite necessary, current security measures.

Privacy Policy

Forester Beauty Supplies (Fox Arts Comics) vows to adhere to the federal privacy policy laws. All personal information provided by our Clients will be handled with utmost confidentiality and will never be passed on to a third party. The Client is able to alter his personal data at any time under the section “My Account”.

Liabilities and Guaranties

These term and conditions govern the entirety of our responsibilities regarding the delivery of our Products. We are not bound to any other guaranties, terms, or regulations except those specifically mentioned in this Contract. This Contract is in accordance with Swiss Trade Law. Forester Beauty Supplies (Fox Arts Comics) in not liable for material, immaterial or physical damage caused by dysfunctional Products or the incorrect usage of Products purchased from our Website. Forester Beauty Supplies (Fox Arts Comics) is also not liable for any damages caused due to Product modifications made by the manufacturer. Forester Beauty Supplies (Fox Arts Comics) liability is limited to the total monetary value of your Order and is not affected by simple mistakes, or omissions which could occur despite consideration of all preventive measures in the process of Product presentation. We are committed in ensuring that we meet the obligations of this Contract but will not be made liable for any loss or damage suffered by you due to delays in the exertion of our obligations or due to any breach in Contract due to matters beyond our control. In case of delays we are committed to carrying out our obligations as quick as possible.

Law/Jurisdiction

The contents of this Contract are governed by Swiss law, namely the guidelines of the Swiss Code of Obligations. For all disputes with Fox Arts Comics the Court of Law is Zurich, ZH, unless deemed otherwise by the Federal Government.

Other Incidents

For all other incidents not covered by these Terms and Conditions, the Swiss Code of Obligations “OR” will apply.

Changes in Terms and Conditions

These Terms and Conditions can be changed or updated at anytime without notice. Any changes will be in effect immediately.
